This ‘Terms & Conditions’ document govern how User uses the content and services provided by ASTROLIGHT (herein referred to as ‘Website’, ‘www.ASTROLIGHT.in’, ‘Company’, ‘App’, Platform, ‘We’, ‘Ours’, ‘Us’,). The term (‘User’, ’You’) are intended towards those who access or utilize our services. Please carefully read the below document to remain in compliance with the terms.

CHANGES & USER CONSENT

Users are informed that this document is subject to changes as deemed necessary by the company and there would be an update/amendment from time to time. If amendment is done after User registers with the site, it automatically applies to him. Continued usage of Platform implies User agrees to accept the terms and conditions. By clicking on ‘Agree’ consent on our app or Website, you agree to abide by the terms and conditions given here. If not, then please do not use this Website. Users registered with the Website, consents, and agrees to Privacy Policy which is to be read and understood along with this document.

WHO ARE WE?

ASTROLIGHT is a guidance platform available in the mode of Website and mobile app. We provide electronic medium for a User to get guidance and suggestions from an Astrologer. In other words, we enable one-on-one communication between a User and an Astrologer.

Our astrologers are professionals who can give proper predictions and suggestions. Actions that are devised on these, will be on the sole responsibility of the User. Any opinion, advice, guidance, prediction, information, and services provided by astrologers are to be regarded as entertainment info.

ELIGIBILITY

Individuals who can form legally binding contracts under applicable law are eligible for the Services provided by us. The Website does not permit services for Users who are resident of a state/country which prohibits by law trade relationships. The Website does not permit services for Users who are restricted by religious practice.

Under Indian Contract Act 1872, a minor under the age of 18 is restricted and prohibited from accessing any contents on the Website. Even though we do not have contents that are harmful for children, we will not be responsible for any misuse by children.

REGISTRATION

A User registers on the Website with his mobile number. Registered User has access to all paid contents and agree to provide accurate, complete, and updated information regarding him. This helps Website to provide appropriate services to the Users.

While entering mobile number, you agree to share the same with the platform and our service providers and validating your account using OTP, User agrees to provide accurate and updated information. While creating a profile, the data asked is considered as ‘Registration Data’ by the Website. A User can create profiles for himself, his friends, family members etc. Each profile information provided must be true and correct for consultations. Posing as someone else and using others account is not permitted. If in case it is found, the Website has the right to terminate the account. The User would be fully responsible for all the activities in their account and the Website is not liable for any loss or damage arising from the User’s failure to maintain secrecy and confidentiality. The User shall notify the Website immediately if they become aware of any unauthorized use of their account or breach of any security. Users are advised to use ‘Log Out’ feature for better safety.

OUR ACCESS TO YOUR ACCOUNT

To provide high quality services astrologers on our Platform access your consultation data. To respond to customer needs and comply with laws, ASTROLIGHT audit team are enabled to access your account and the records are reviewed individually only when a need to investigate complaints or allegations of abuse arises. By signing in, you are giving consent for the same.

CONDITIONS

• The Website does not permit services for a fraudulent User who creates many accounts using different mobile numbers.
• User shall not post any information deemed unlawful, abusive, defamatory, invasive of privacy, vulgar, obscene, profane, or otherwise objectionable, which encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any law. Such User accounts will be suspended or terminated.
• The Website reserves the right to terminate the access or to change or discontinue any services, graphic, feature, content, deals or offers. This may or may not be brought into the notice of the User.
• Members/Users should not rely on or make any legal, health, finance or other important decisions based on the guidance provided by an Astrologer. Do consult a qualified professional for guidance related to medical or mental health.
• The consultations are meant as pure suggestions and not to be taken as advice, platform does not guarantee results. Hence User must access the platform at his own risk.
• During consultation there could be file transfer between the User and the Astrologer. Users are solely responsible for scanning such files using an anti-virus software application before opening them on your system or device.
• Under its sole discretion, the Website may refuse to post any content uploaded by a User, resulting in removal or deletion of the same.
• User agrees, understands, and confirms that all information included but not limited to personal data, cards, bank account info are susceptible to hacking, theft or fraud. The Website or payment gateway providers has no control on this.
• If User’s mobile number is on ‘DND [Do not disturb]’ with a service provider, and he has registered with the Website, the Website reserves the right to call for marketing and astrological consultations.
• User allows all kinds of data registered with the Website to be accessed by employees or agents or authorized authority appointed by the Website.
• The Website shall investigate any complaints or suspected abuse, reported on case to case, after thoroughly checking the records available. Astrolight retains the right to record all services such as chat, call, and video call. This is done as per mutual agreement with the parties. The compliance team conducts regular audits of these recorded data and customer reviews on a weekly, monthly, and yearly basis.
• Users will not threaten, harass, stalk, or use abusive or offensive language on any other User, Staff or Astrologer associated with the Website. The violation of this will result in the termination of account and wallet amount will be seized and not refunded. The Website reserves the right to withdraw its services to any customer who is found to be unreasonable or abusive during their conversation with our support team or any service provider inclusive of astrologers regardless of any reason.
• By using the Site, Application or Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Members, inclusive of the service provider registered with the Website or other third parties linked with the Website, shall be limited to claim against such party who may have caused any harm. You understand that the Website is not responsible for such actions and omissions and any liability or legal remedy sought on this is considered invalid.
• The User agrees that the timelines displayed on the Website are approximate and all essential steps would be taken to adhere to the timelines as displayed on the Website.
• The User shall not resell or use any info from the Website for commercial purpose without the consent of the Website. The User shall not display, perform, reproduce, publish, license without written consent from the Website. In the same manner modify, copy, distribute, transmit, transfer, or selling any information or software obtained from the Website is illegal.
• Users are not permitted to decrypt any kind of data associated with the application. Any attempt to derive or reverse engineer the source code will lead to facing criminal charges under Information Act 2000 section 65.
• The User is under an obligation to report any misuse of the site. Any false complaint made by a User shall make such User liable for termination of his account with the Website.
• The User agrees to receive communication through notification system in the app/Website, also through email/SMS or any other communication medium including through WhatsApp Business messages pertaining to the usage of the app/Website and promotional advertisements.

TERMINATION

• Violations of any conditions mentioned will lead to termination of account of the User. The wallet amount will be seized and not refunded back.
• The User account will be terminated, if the User registration information is non verifiable or not authenticate.
• The User account will be terminated, if any action of User causes legal issues for the Website.
• Violation of Privacy policy or User interfering with Website administration activities will result in termination.
• All service providers including astrologers must strictly adhere to Service Terms and Conditions, any deviation will lead to termination of such service providers. User must understand this and be cautious while sharing information.

FEES and PAYMENTS

For any interaction performed online or offline and for all communications between you and an astrologer, the billing is done through the Website. While booking a service, you agree to accept the price shown for a specific service from an astrologer. A wallet is provided in the app and Website. Users can add money to the wallet. For certain services money is deducted from wallet while rendering the service based on the minutes you have consumed. For certain services the money from wallet is deducted before the commencement of the service. These are but done after confirmation from the User. User can check his wallet balance at any time. Money addition to the wallet is done through a secured payment gateway. The gateway provides various modes like Netbanking, Cards, Wallet and UPI. It is your responsibility to ensure that the payment information provided by you is accurate and always updated, and that you fully approve the usage of any payment mode. You may be required to verify your account or payment method using your email or mobile number. User should be aware that there are services for which the Website deducts money directly from payment gateway. Instead of deducting from wallet, you will be directed to payment gateway for such transactions.

You authorize payments for each transaction processed under your account. All amounts displayed on the Website or application are in US dollars/INR, and you will be charged accordingly. Any invalid payments or past dues will be charged combining the taxes and late fee.

All services are charged on time basis. Time charges are based on a per minute. There are services which are based on time slots too. A part of a minute is rounded to a full minute during usage. It is to be understood that any billing system is never fault-free, and the same is applicable to our system too. Any such miscalculations or malfunctions during the processing of payments will be corrected and actions taken if communicated to the support team.

REFUND & CANCELLATION

• Once a consultation booking or any service reaches the processing stage, there will be no refund. Similar is the case when a consultation is executed. Users are advised to be careful while placing an order.
• Users can cancel (permitted services) or purchases within stipulated cutoff time. In case these has been placed by mistake, contact customer support for assistance. Refunds and cancellations will be strictly applicable only as per the conditions.
• For scheduled calls, make sure the contact number is in full coverage area. The Website repeats at least three try before deeming a call as non-connectable. No refunds will be given for calls that were connected but not received.
• No refund shall be made if data for consultations and report generation, provided by the customer is incorrect.
• Refuse, accept or cancel a booking is at the sole discretion of the Website. Cancellation might happen due to unavailability of a consultant, inaccuracy, error in pricing. If money deducted, this will be refunded.
• Any refund initiated will be audited by our backend quality team. It can take up to 7 business days for analysis and refund amount back to wallet. This is also subject to transaction and processing time taken by bank/payment gateway.
• Any amount refunded will be reflected in the User wallet.
• Refund will be initiated if there is a network issue, weak signal, background noise, inaudible consultant etc.
• Refund will be initiated if consultant not able to respond fluently in language chosen by the User.
• Refund will be initiated if consultant takes long enough time to respond to query from the User.
• Refund will be initiated if consultant provided irrelevant response to User query.
• Refund will not be initiated for lack of accuracy or factual accuracy of consultations.
• The company will reimburse the precise amount deducted for the service from the user's wallet after conducting an audit. However, the company is not obligated to provide compensation for issues such as lack of accuracy, network issues, waiting time, etc.
• Return of any damaged product is not possible and refund for the same shall not be processed. While ordering a product displayed on our Website, post its delivery, User agrees to be fully responsible for any damage caused to the product. Any damage that may be caused while in transit shall be dealt by the Website and its agencies.
• User should understand and agree that the pictures depicting the product is only for reference purpose and the Website will try to deliver the product ordered which almost matches in look as displayed. The User is advised to exercise discretion in such case and no refund shall be issued on such grounds.
• The Website holds no responsibility or liability about the reality/reliability of the gems and other astrological items sold on the Website. The placing of order for buying such products or taking the services is solely on the discretion and will of the User and the Website does not have any responsibility upon the products sold. The User is advised to exercise discretion in such case and no refund shall be issued on such grounds.
• The refunds, if any, shall be processed after deduction of the transaction charges levied by the Bank and/or the Payment Gateway, to-and-fro cost of the shipping and/or courier charges (With regard to purchase of a product listed on the Website), customs duty (if levied) and/or any other charges that may have been incurred by the Website during processing and/or delivering the service, as applicable.

PAYMENT GATEWAY REFUNDS

• It is common for the Website or any third-party providers like payment gateway to experience server related issues like ‘slow down’, ’failure’ or ‘session timeout’. Before retrying a failed payment, User must check whether his/her Bank Account has been debited.
• In case the Website or Payment gateway’s webpage, that is linked to the Website, is experiencing any server related issues like ‘slow down’ or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options:
• **In case the Bank Account appears to be debited, ensure that you do not make the payment twice and immediately thereafter contact the Website via customer care to confirm payment.
• **In case the Bank Account is not debited, the User may initiate a fresh transaction to make payment.
• **However, refund for multiple payment, if any, even after the above precaution against the same order shall be refunded in full without deduction of the transaction charges as mentioned above. The Website shall only retain the cost of one single order as intended to be placed by the User.
• Any refund initiated will be audited by our backend quality team. It can take up to 7 business days for analysis and refund amount back to wallet. This is also subject to transaction and processing time taken by bank/payment gateway.

SHIPPING POLICY

We ship our products to addresses within India and internationally. All orders are processed within 1-3 business days after payment confirmation.

Domestic Shipping:

For Domestic (India) Orders: We use reputable courier services for domestic deliveries, ensuring timely and safe shipment of your products. Delivery within India usually takes 3-7 business days, depending on the location of the delivery address. We charge a nominal shipping fee that will be applied at checkout depending on your pin code. We provide tracking information, so you can stay updated on the status and location of your shipment. You will receive an Email/WhatsApp/SMS with the tracking details once your order has been dispatched. You can track the information on the delivery partner site.

International Shipping:

For International Orders, we partner with reliable international couriers to deliver your products safely and efficiently to your chosen destination. Delivery to international destinations typically takes 7-14 business days, depending on the country and customs processing times. International Orders: Shipping charges for international orders will be calculated at checkout based on the destination and package weight. For international orders, we provide tracking information, so you can stay updated on the status and location of your shipment. You will receive an Email/WhatsApp/SMS with the tracking details once your order has been dispatched. You can track the information on the delivery partner site. For international orders, customers are responsible for any customs duties, taxes, or import fees that may apply in their respective countries. These charges are not included in the product price or shipping cost and will be the customer's responsibility.

Please ensure that the shipping address provided during checkout is accurate and complete to avoid delays or mis-deliveries. We ensure that all shipments are securely packaged to prevent damage during transit. However, if your package is damaged or lost during shipment, please contact our customer support team, and we will assist you in resolving the issue. If there are any delays or issues with your shipment, please contact our customer support team, and we will promptly address the situation to ensure your satisfaction.

FORCE MAJUERE

Neither the Company nor the App shall be liable for damages for any delay or failure to perform its obligations hereunder if such delay or failure is due to cause beyond its control or without its fault or negligence, due to Force Majeure events including but not limited to acts of war, acts of God, terrorism, earthquake, flood, strike, riot, fire, explosion, festive activities sabotage, labour shortage or dispute, internet interruption, technical failure, breakage of sea cable, hacking, piracy, cheating, illegal or unauthorized acts, riot or other civil commotion, failure in transportation, act of any government or any court or administrative agency thereof, epidemics or quarantine restrictions, or other cause(s) beyond the reasonable control of Us (“Force Majeure”). Upon cessation of the cause of the Force Majeure, the Terms explained here, shall again become fully operative.

LEGAL LIABILITY

In case of loss of, unauthorized access to, or alteration of, a User’s transmission of data arising out of security compromise, the liability of ASTROLIGHT or any third party or suppliers connected with us, the terms of service (however arising, including negligence) is limited to the GREATER of a) The amount of fees paid to the platform in a year or b) $100 or its INR equivalent.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless ASTROLIGHT.com and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from Your use of the Services, Your violation of the Privacy Policy or these Terms of Service, or Your violation of any third party's rights, including without limitation, infringement by You or any other User of Your account of any intellectual property or other right of any person or entity. Users are not permitted to use the website or application to send any automated queries or unsolicited mails to any other websites and the user must not alter any proprietary notices. These Terms of Service will inure to the benefit of ASTROLIGHT’s successors, assigns, and licensees.

PROPRIETARY RIGHTS TO CONTENT

You acknowledge that the Content, including but not limited to text, software, music, sound, photographs, video, graphics, or other material contained in either sponsor advertisements or distributed via email, commercially produced information presented to Member by ASTROLIGHT.com, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents and/or other proprietary rights and laws. You are not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless expressly authorized by ASTROLIGHT.com, its suppliers, or advertisers.

NOTICE

Except as otherwise stated in these Terms of Service, all notices to a party shall be in writing and shall be made either via email or snail mail. Notice shall be deemed given 24 hours after an email is sent, or 3 days after deposit in the snail mail, to Member at the address provided by Member in the Registration Data and to ASTROLIGHT.com at the address set forth below:

RESTRICTED CONTENT

Child Abuse: Any kind of action categorized under child abuse or exploitation is prohibited on this Website. Appropriate action will be taken, and law enforcement authorities will be notified.

Inappropriate content: The Website is a safe place and does not promote sexual content or profanity, including pornography, or any content or services intended to be sexually gratifying. Accounts of Users sharing or promoting such contents will be terminated and appropriate law actions will be taken against them.

Hate Speech: Any kind of content sharing that incites communal disharmony is not permitted on the Website. Any content that promotes terrorism and incites violence is restricted and Users who promote these will be terminated and appropriate actions will be taken.

Bullying & Harassing: Our platform does not allow harassing or bullying of astrologers or other Users using any content.

Selling of dangerous product: Our site does not sell dangerous products like firearms, drugs, weapons, tobacco, and alcohol. Users are warned to stay away from such illegal activities.

BlackMagic and other unethical practices: Users and astrologers are strictly warned against promoting such activities on the Website.

OUR SERVICES

ASTROLIGHT may contain information provided by Users in the form of feedback, blogs, testimonials etc. Also, our services may contain links to third party software which are not controlled by ASTROLIGHT. We clearly do not assume any responsibility for content, policies, or practices by the above said. We do not assume responsibility for mistakes, misinterpretation of law, defamation, omissions, falsehood, obscenity, pornography or profanity in the statements, opinions, representations, or any other form of third-party content on the Site as well as that of its Users. By using the Service, you expressly acknowledge and agree that ASTROLIGHT shall not be responsible for any damages, claims or other liability arising from or related to your use of any content and third-party Website. The information and opinions are solely owned by others and is neither endorsed by nor does it necessarily reflect ASTROLIGHT belief.

Right to Modify, Correct and Discontinue

We cannot warrant that the Website will be error-free, virus free or free of other components, or that defects will be corrected. We strive to get accurate, correct, and timely information on our website but cannot warrant that. If deemed necessary, we will bring about changes to our functionality and contents at any time. We reserve the right in our sole discretion to edit or delete any documents, information, or other contents on the Website. We reserve the right to modify or discontinue. temporarily or permanently, the Services and/or Sites (or any part thereof) with or without notice. ASTROLIGHT is not liable to you or to any third party for any modification, suspension or discontinuance of the Service or any Sites.

Disclaimer: Users are advised not to solely rely on astrological predictions while making important legal, financial or health related decisions.

GOVERNING LAW AND JURISDICTION

• Any dispute, claim or controversy arising out of or relating to this Terms of Usage including the determination of the scope or applicability of this Terms of Usage to arbitrate, or your use of the Application or information to which it gives access, shall be determined by arbitration in India before a sole arbitrator mutually appointed by Members and Website. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Bengaluru. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.
• Notwithstanding the foregoing, either party has the right to seek any interim or preliminary relief from a court of competent jurisdiction in Bengaluru to protect the rights of such party pending the completion of any arbitration hereunder, and both parties agree to submit to the exclusive jurisdiction of the courts of India and venue in Bengaluru for any such proceeding. If either party files an action contrary to this provision, the other party may recover attorneys' fees and costs up to One Lakh Rupees INR.
• These Terms of Usage shall be governed by and construed in accordance with the laws of India without giving effect to any choice of law and principles that would require the application of the laws of a different state. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms of Usage or Privacy Policy to be unenforceable or invalid, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law, and the remainder of the Terms of Usage or Privacy Policy, as applicable, will continue in full force and effect. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Any waiver of any provision of the Terms of Usage shall be effective only if in writing and signed by ASTROLIGHT. These Terms of Usage constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
• These Terms of Usage and your use of the Services will be interpreted in accordance with the laws of India excluding its rules on conflicts of laws. The parties agree to submit any dispute arising under these Terms of Usage to the jurisdiction of a court located in Bengaluru for any actions for which the parties retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
