This ‘Terms & Conditions’ document govern how Advisors [Astrologers/Pandits] uses the content and services provided by ASTROLIGHT (herein referred to as ‘App’, ‘Company’, ‘Astrolight’ ‘We’, ‘Our’, ‘Us’, ’Pandit App’). The term (‘User’, ’You’, ‘Astrologer’) are intended towards Advisors who access or utilize our services. Please carefully read the below document to remain in compliance with the terms. This document is a contract between ASTROLIGHT [Gold Tree Astrolight Pvt Ltd] and Advisors [Astrologers] [who use ‘ASTROLIGHT PANDIT APP’ herein referred to as ‘Users’] to provide services to customers.
CHANGES & USER CONSENT
Notice: Amendments to Terms and Conditions
Please be advised that this document is subject to revisions as may be deemed necessary by the company, and updates or amendments may be made from time to time. If any amendments are implemented after a User has registered with the Company, such changes will automatically apply to the User. The continued usage of the Pandit App implies that the User agrees to accept the updated terms and conditions.
By clicking on the 'Agree' button on our app, you consent to abide by the terms and conditions provided herein. Any modifications to this document will be communicated through email or any notification system present within the app. The last updated date can be found under 'Page Updated' on the top left of the document.
Your continued use of the App signifies your acceptance of the revised terms and conditions. If you do not agree with any such changes, your sole and exclusive remedy is to terminate your use of the Application. We strongly encourage you to review the "Terms and Conditions" every time you log in to the application, as the most recent version will be applicable at any given time of application usage.
APPLICABILITY OF THE TERMS
Upon association with Astrolight, you will be required to provide the following information:
1. Profile Photo: Please upload a photo of yourself. It is advised not to use this photo on any other internet platform and keep it exclusively for use on the Astrolight App.
2. Screen Name: You can select a unique display name for the application.
3. Other profile information: Full Name, DOB, Address, Certifications, Gender, Languages, Areas of Expertise, Pan Number, Aadhaar Number, Bank Account etc. These information’s are collected and stored on data secure servers. Astrolight assures you that all these are required information for your association with Astrolight. Any changes to this information can be done from Astrologer App. This will need approval from admin. Once approved your profile will reflect the changes.
4. Any information provided by astrologers, including the above-mentioned details, can only be modified with prior consent from the admin team. All the information you provide about your identity to Astrolight must be accurate and true to the best of your knowledge and belief. In the event of any falsification or inaccuracies being discovered, fine will be imposed [see clause, and your account will be deactivated. Subsequently, you will no longer be able to offer services to customers through our platform.
5. When delivering a service, you must refrain from disclosing your personal identity, including your actual name or media handles. Please use your screen name for all interactions, including reviews and comments. Any business conduct with customers must be in the best interest of Astrolight. Violation of this clause will result in penalty and your account will be deactivated immediately.
6. After the termination of the contract under any circumstances, you agree not to use the same screen name and profile photo in any applications or media for a duration of 5 years.
7. You are permitted to promote your services solely in connection with Astrolight, and the profile photo and Screen Name used here should not be utilized on any other similar apps. By signing up and creating a profile, you agree to grant Astrolight permission to use, reproduce, modify, adapt, publish, translate, create, distribute, transmit, and display any part of your profile, online or offline for marketing, promotional, or branding purposes of Astrolight through media such as print, TV, radio, internet, etc., both within India and worldwide.
8. In the event of termination, Astrolight reserves the right to display any data associated with your profile (e.g., testimonials, advertisements, articles, blogs, comments) for a continuous period of 3 years.
9. If your account remains inactive for a period of 3 years, it will be automatically terminated.
CODE OF CONDUCT
10. Astrolight retains the right to record all services such as chat, call, and video call. This is done as per mutual agreement with the partiesThe compliance team conducts regular audits of these recorded data and customer reviews on a weekly, monthly, and yearly basis.
11. Upon becoming associated with Astrolight, you are obligated to treat customers with courtesy. Any use of offensive language will result in the deactivation of your account along with penalty as decided by the company. Reactivation may be considered based on the severity of the misconduct.
12. Maintain proper decorum and provide answers to all customer queries. You agree not to share any customer-supplied sensitive information during consultations or disclose the advice on social media. Failure to comply will result in a penalty of Rs. 1,00,000/- and immediate account deactivation.
13. You agree not to upload, post, email, transmit, or make available any content through Astrolight that is unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable.
14. The conversation time between you and customer need to be used for providing consultation. Do not discuss anything that is not pertaining to the solution/advice. Dragging a service unnecessary for financial gains would attract penalty. The maximum turnaround time should not exceed 5 mins. The service charges will be refunded if customer complaint arises or found during audit.
15. Astrologers are not supposed to commit anything beyond their capabilities. Any assurance which can't be controlled by Astrologer is not committed. Giving assurance of 100% of results also falls in the same category. Violation of the clause will lead to the deactivation of the astrologer profile and a penalty of Rs. 21000/-.
16. You are obliged to work in the interest of Astrolight. Posting negative comments or making defamatory comments against company or anyone associated with the company including employees, agents, other astrologers, or affiliates will lead to immediate deactivation.
17. Promoting other platform/competitors providing similar services to Astrolight will attract a penalty of Rs. 25,000/- and deactivation of account.
18. Sharing personal messages containing contact numbers, payment modes, account numbers, apps, email, or social media profiles with customers seeking advice is not permitted. You will not induce the customer for offline meetings or ask for personal favours. Any kind of request to the customer through chat/call sharing personal bank account and asking for money transfer is considered an offence. Service charges for that consultation will be deducted, and the account will be deactivated.
19. Demanding any extra charges from a customer for any service [inclusive of ‘Free’ services] will attract stringent action from the Company. You will serve the promotional calls in a cordial manner with the same passion and eagerness that you would exhibit in any other paid call and treat all customers with respect. Knowingly you will not cut/avoid any promotional/free call.
20. The Compliance Team at Astrolight will regularly conduct audit of reviews, chats, and calls. This is as per mutual agreement with parties. Do not share your credentials with anyone. Do not share Astrolight specific data or documents with anyone. You are not permitted to provide consultation to the customer through anyone else by impersonating you before the customer. If found suspicious the profile will be deactivated and if found guilty a penalty of Rs. 25,000/- will be imposed and account will be terminated immediately.
21. Online presences on the app requires a minimum of 4 hours of login daily. Special reasons (approved by the admin) can permit meeting the weekly average of 28 hours instead of the daily minimum.
22. You are allowed to promote only products from AstroShop in the application or products promoted by Astrolight. Any personal services and product marketing for personal gains during consultation is strictly not permitted. Suggestion of products and getting it listed on remedy report only to be done. Do not force a customer [ by emphasizing negative effects, threatening or bad outcomes] to buy the product. If found violating the same clause, you will be terminated.
23. Astrolight is a platform for Astrologer to provide consultations and suggest ethical remedies. Promoting unethical practices like Black Magic will invite a penalty of Rs. 25,000/-. Depending on the graveness of the misconduct, the compliance team will decide on termination or reinstation of your profile.
24. Remedies are pure suggestions and must have an ethical base. Your suggestions or advice must not prove life threatening for any human being or animal. If found guilty by audit team, you will have to face a penalty of Rs. 1,00,000/-, termination and law related charges.
25. You will not advise any remedy, treatment or course of action that requires in-person physical examination of the customer. If found guilty by audit team, you will have to face a penalty of Rs. 1,00,000/-, termination and law related charges.
26. You agree to respect everyone associated with Astrolight including staff, other astrologers etc. and not to ill talk about them to customers. You are not permitted to defame or humiliate any other Astrologer by declaring them less capable, inefficient, less knowledgeable, etc. You will not stalk, intimidate, or harass any Astrologer or User or infringe upon or attempt to violate upon their privacy. Such conduct is not acceptable, and termination of account will be done.
27. Below is a list of predictions that you need to refrain from:
a) Prediction of sex of an unborn child.
b) Date and time for surgery or medical consultations.
c) Prediction for criminal offence planned by customer.
d) Anything related to gambling, drug-abuse, money-laundering etc. e) Prediction of death related to accidents or medical emergency.
Any violation of the above said clause will attract a penalty (depending on the graveness of the misconduct), termination followed by law charges.
28. Repeated offenders will be terminated immediately. On termination, the company [Astrolight] is not obliged to pay the Astrologer the pending dues for his services.
29. You shall raise refund request voluntarily for any unsatisfied customer asking for a refund inclusive of wrong prediction, internet issues, etc. If customer raises a complaint on the same, the refund shall be initiated by admin without your consent.
30. You are requested to deliver any kind of service chat, call, video call, Ask a question, Astrochart etc with utmost sincerity. Do not copy predictions, copy paste already available sun sign predictions etc. You are likely to attract a penalty for the same. Repeated offenders will be terminated immediately.
31. You are requested to politely reply to negative comments while on a conversation through any service and on reply to reviews and feedbacks. Even though admin will recheck each review with a rating below 3 stars, customer feedback and your reply will be scrutinized and dealt with in an appropriate manner. Astrolight maintains sincere approach and negative comments will be cross checked with recordings to determine the authenticity. If found fake, based on analysis by our audit team, these will not be published on the platform. Else all reviews will be published.
32. A punctual login as already mentioned on your timetable will help in reliability, increasing loyal customer base and personal growth. A delayed login and variations in login and logout time will cause cancellation of bookings and a negative impact. Such astrologers will be given low priority and incentives will be deducted.
33. Pricing changes can be requested and agreed by admin. You are advised not to keep changing prices creating a confusion in the system and with customers. Approval from admin is based on your performance. Once approved, this will reflect on your profile in User App and Astrologer Dashboard. The new bookings will reflect the new price, already queued bookings will be based on the old price.
34. Your agreed share of price for a service is reflected on the dashboard and can be changed. The change will be approved based on your performance.
35. Your price for services is subjected to discounts, promotional offers etc. floated by Astrolight from time to time. You agree to comply with these changes. Your earrings might reflect complete amount of the service soon after the service is completed. A deduction of the amount provided as promotional offer to the customer is later deducted from your earrings by admin before deposit to your account. The complete details of earrings with additions and deductions will be detailed and reflected on your report.
36. Any feature related changes inclusive of addition, deletion or upgradation will be notified through notification systems associated with the application. Your continued use of the application signifies your acceptance of the changes.
37. Payment gateways accepting international payments will require presenting evidence to resolve complaints. Any refund will be associated with deduction of other charges associated with it. These charges will be shared between you and Astrolight. You duly consent for the same.
INDEMNITY
a. You agree to indemnify the App, its affiliates, directors, employees, and other officers against any claims, liabilities, actions, proceedings, demands, expenses, etc., which the App may incur or suffer in connection with any proceeding arising out of:
i. Your use of the platform.
ii. Any unauthorized use and violation of the profile created and managed by you on the App.
b. Astrologer acknowledges that in no event shall Astrolight Portal be liable for any damages whatsoever, whether direct, indirect, general, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of Astrologer or anyone else in connection with the use of the Astrolight Portal., including without limitation, bodily injury, emotional distress, and/or any other damages resulting from communications or meetings with other registered Astrologers of this service or persons met through this service.
c. Before bringing any claim for indemnification, the indemnified party shall notify the indemnifying party of the indemnifiable proceeding and provide all legal pleadings and other documents reasonably necessary to indemnify or defend the indemnifiable proceedings.
d. If the indemnified party fails to notify the indemnifying party of the indemnifiable proceeding, the indemnifying party will be relieved of its indemnification obligations to the extent that it was prejudiced by the indemnified party's failure.
NON-DISCLOSURE CLAUSE
a. The Astrologer acknowledges and accepts full responsibility for all actions, services, advice, postings, and transmissions made from their account. They agree that any information or content posted or transmitted by them shall not be considered confidential and will be owned by Astrolight, regardless of its personal nature.
b. Furthermore, the Astrologer warrants that any information shared by members or users with them will remain confidential, and they will make their best efforts to safeguard their privacy.
c. The Astrologer shall not share access to the astrologer management platform with any third party and agrees not to disclose the terms and conditions between Astrolight and themselves. Any such disclosure will be considered a breach of confidentiality and may result in the termination of their association with the platform.
d. During their engagement with the Company, the Astrologer shall not divulge or disclose, in any form or manner, any information, trade secrets, processes, or details related to the Company's trade, business, or any other connected matters. They shall maintain strict confidentiality regarding all information concerning the Company.
GOVERNING LAW AND JURISDICTION
a. All disputes arising from the present Terms shall be subject to the laws applicable in Bengaluru, Karnataka.
b. The Courts located in Bengaluru shall have exclusive jurisdiction to adjudicate and resolve any disputes arising between the parties under these Terms.
c. In the event of any dispute arising from these Terms and the App, the parties agree to initially explore alternative modes of dispute resolution, including but not limited to Arbitration, Mediation, and Conciliation.
d. The Award rendered by the Arbitrator shall be considered final and binding upon both parties.
SEVERABILITY
a. The Parties acknowledge that if any provision of these Terms is deemed illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall continue to be fully valid and enforceable.
b. In the event that a clause is declared or determined to be unlawful or unenforceable, that particular clause shall be removed from these Terms, while the other Clauses shall remain unaffected and continue to be valid even if one clause is declared unlawful or unenforceable.
OTHER GENERAL PROVISIONS
a. Limitation of Liability: Both parties shall not be held liable for breach-of-contract damages that are considered remote or speculative, or that the party in breach could not have reasonably foreseen at the time of entering into these Terms.
b. Assignment: Neither party is permitted to assign these Terms or any of their rights or obligations under these Terms without obtaining the written consent of the other party.
